Florida's 2025 Minimum Wage Updates
Florida's minimum wage is set to increase to $14.00 per hour on September 30, 2025, as part of the state's constitutional amendment approved in 2020. This amendment mandates a $1.00 annual increase each September 30 until the minimum wage reaches $15.00 per hour by September 30, 2026.
What's in the New Rule?
Employer Requirements
• Ensure all employees are paid at least the new minimum wage starting September 30, 2025.
• Update payroll systems and budgets to accommodate the wage increase.
• Post the updated minimum wage notice in a conspicuous location accessible to all employees.
Tipped Employees
For tipped employees, Florida law allows employers to take a tip credit of up to $3.02 per hour. Therefore, the direct cash wage for tipped employees will increase to $10.98 per hour on September 30, 2025.
Penalties for Non-Compliance:
Employers who fail to comply with Florida's minimum wage laws may be subject to:
• Payment of back wages owed to employees.
• Liquidated damages equal to the amount of unpaid wages.
• Fines and penalties imposed by the Florida Department of Economic Opportunity.
Employees may file complaints with the Florida Attorney General’s office or pursue civil action against non-compliant employers.
